Terms of Service
Last updated: 12 October 2026
Please read these terms carefully before using PortTrip. By creating an account or using the service, you agree to be bound by them. Questions? Email info@porttrip.com.
1. Acceptance of Terms
By accessing or using PortTrip (the "Service"), you confirm that you are at least 13 years old and agree to these Terms of Service ("Terms"). If you are using the Service on behalf of an organisation, you represent that you have authority to bind that organisation to these Terms.
If you do not agree to these Terms, do not use the Service.
2. Description of the Service
PortTrip is an AI-powered itinerary planning platform for cruise passengers. The Service allows you to:
- Generate personalised day plans for cruise port stops
- Track timing, transport, and budgets for port excursions
- Access port guides, travel tips, and community insights
- Find and compare booking options for tours and attractions
- Manage multiple cruises and port days in one place
- Coordinate shore tours with other passengers on the same sailing (Crew, see section 9)
The Service is provided on a subscription basis. Some features are available on a free tier; others require a paid Cruise Pass or Pro subscription.
3. Advisory Nature of Itinerary Data
Important: Itineraries are advisory only.
All itineraries, transport times, route suggestions, and cost estimates generated by PortTrip are provided for planning guidance only. They are not a guarantee of real-world conditions.
Specifically, you acknowledge and agree that:
- Transport estimates (walking times, taxi durations, transit routes) are approximations and may differ from actual conditions
- Real-time traffic, delays, port congestion, or tender queues may significantly affect your actual journey time
- Attraction opening hours, entry prices, and availability change and may not be current
- AI-generated recommendations are based on historical data and general knowledge — not live, verified information
- You are solely responsible for verifying all practical details before your port visit
4. User Responsibility for Making Your Ship
You are responsible for returning to your cruise ship on time.
PortTrip provides planning tools and time buffers as guidance. However, PortTrip is not responsible for missed ships, missed all-aboard times, additional travel costs, or any consequences arising from a passenger not returning to their vessel on time.
Always allow more time than you think you need. All-aboard times are strictly enforced by cruise lines and ships do not wait. If in doubt, err on the side of caution and return to the port earlier.
5. Account Usage
- You are responsible for maintaining the security of your account credentials
- You must not share your account with others or use the Service on behalf of another person without their consent
- You must provide accurate information when creating your account
- You must not use the Service for any unlawful purpose or in violation of these Terms
- One account per person; bulk or automated account creation is not permitted
6. Subscriptions and Payments
PortTrip offers the following plan types: a free tier, a one-time Cruise Pass, and a yearly Pro subscription. Pricing is displayed on the Pricing page and within the app.
- The Cruise Pass is a one-time payment; Pro is billed yearly in advance
- Payments are processed securely by Stripe
- You may cancel your subscription at any time; access continues until the end of the current billing period
- Refunds within the first 30 days are covered by section 7; after that we do not refund unused subscription periods except where the law requires it
- We reserve the right to change pricing with reasonable notice (minimum 14 days) to existing subscribers
7. Refunds and Your Right to Cancel
You can ask for a full refund within 30 days of your purchase. Contact us using the details in section 16 and we will refund the full amount you paid. You do not have to give a reason.
For the one-time Cruise Pass, the 30-day period runs from the date of purchase. For Pro, it runs from your first payment; after that you keep access until the end of the period you have already paid for, and you can stop the renewal at any time from your account.
Refunds are returned to the payment method you used. Stripe usually takes 5-10 business days to show the refund on your statement.
Nothing in this section limits your statutory rights as a consumer, including any right to withdraw from a distance contract that applies to you. Where you have asked for immediate access to digital content and acknowledged that you lose the right of withdrawal, the voluntary 30-day refund described above still applies.
8. Third-Party Links and Affiliate Relationships
PortTrip includes links to third-party booking platforms, tour operators, and ticket providers. Some of these are affiliate links — meaning we may earn a commission if you make a purchase, at no additional cost to you.
- We do not control or endorse third-party websites or services
- PortTrip is not a party to any transaction you make on a third-party platform
- Third-party terms, pricing, cancellation policies, and availability apply once you leave PortTrip
- We are not responsible for the accuracy or fulfilment of third-party bookings
We strive to recommend only reputable providers, but always verify booking details directly with the operator.
9. Crew: Tours Organised by Passengers
9.1 What Crew is. Crew lets passengers on the same sailing propose, join and coordinate shore tours with each other. Every tour on Crew is proposed and run by a passenger (the "Organiser"). The passengers who join are "Members".
9.2 PortTrip's role. PortTrip only provides the space where tours are listed and coordinated. PortTrip:
- is not the organiser, operator, seller or agent of any Crew tour
- is not a party to any agreement between Organisers, Members and tour providers
- does not take payment for Crew tours and does not earn a commission on them
- does not check, select, vet or endorse any tour, Organiser, Member or provider
9.3 Who may organise. You may propose a tour only if you are a passenger booked on that sailing, you are at least 18 years old, and you act as a private individual. Tour operators, guides, drivers and other businesses may not propose tours, recruit passengers or advertise on Crew. You may not use Crew to sell anything.
9.4 Prices and payment. The price shown on a tour is the Organiser's estimate per person. It is not an offer from PortTrip. You pay the provider, or settle with the Organiser, directly. PortTrip has no part in that payment. Do not send money to anyone you have not met. The provider's own terms decide refunds, cancellation and any dispute about price.
9.5 Organiser responsibilities. As an Organiser, you are responsible for what your listing says, including the meeting point, meeting time, price estimate and back-by time. You must describe the tour honestly, tell Members promptly if the plan changes, and cancel the tour on Crew if it will not go ahead. Choosing a provider is your decision and your responsibility.
9.6 Your own responsibility. Joining a Crew tour is your own decision. Before you join, you are responsible for judging whether the tour, the provider and the plan suit you, including licences, insurance, safety, accessibility and local requirements such as visas or the documents you must carry ashore. Treat a Crew tour as you would any arrangement made with fellow travellers you have not met before.
9.7 Getting back to the ship.
Section 4 applies in full to Crew tours. Each passenger is personally responsible for being back on board before all-aboard time, whatever the Organiser, other Members or the provider do. A back-by time on Crew is an estimate based on published schedules. Your ship's actual all-aboard time is the time printed in your daily programme. If the group is running late, leave the group and make your own way back. Ships do not wait for independent tours.
9.8 Contact details. When you join a tour, your display name and email address are shared with the Organiser so the tour can be coordinated. When you organise a tour, your email address is shared with your Members. Use these details only to coordinate that tour. Do not add anyone to mailing lists, pass their details on, or contact anyone after they have left or cancelled. Our Privacy Policy explains how PortTrip handles this data.
9.9 Content rules. You must not post false, misleading or unlawful content; advertising, links or payment requests; other people's personal data; or content that harasses, discriminates against or endangers others.
9.10 Reports and removal. You can report a tour or a user at info@porttrip.com. Tell us what the problem is and why you think it breaks these Terms or the law. We may remove a tour, end a signup or restrict a user's access to Crew if we reasonably believe these Terms or the law have been broken. When we do, we will tell the affected user what we removed and why, unless the law prevents us. That user can reply to ask us to review the decision.
9.11 Liability. PortTrip is not liable for the acts or omissions of Organisers, Members or providers; the quality, safety, legality or cancellation of any Crew tour; any payment made for a Crew tour; or any missed all-aboard time or departure. Section 11 applies to Crew. Nothing in these Terms limits or excludes liability for intent or gross negligence, or any liability that cannot be limited or excluded under mandatory law.
9.12 Changes to Crew. We may change, suspend or end Crew at any time. If we ever start charging for Crew or take a commission on tours, we will update these Terms first.
10. Intellectual Property
All content, design, software, and AI-generated outputs on PortTrip are the property of PortTrip or its licensors. You may not copy, reproduce, distribute, or create derivative works from the Service without our express written permission.
Content you create within the Service (your itineraries, notes, and plans) remains yours. You grant PortTrip a limited licence to store and display it to power the Service.
11. Limitations of Liability
To the fullest extent permitted by applicable law, PortTrip and its operators shall not be liable for:
- Missed cruise ships or all-aboard times
- Transport delays, cancellations, or service disruptions
- Inaccurate or outdated attraction information, opening hours, or prices
- Any loss or damage arising from reliance on AI-generated itinerary content
- Any indirect, incidental, special, or consequential damages
- Loss of revenue, profit, data, or goodwill
Our total liability to you in any calendar year shall not exceed the amount you paid to PortTrip in that same period, or €50 — whichever is greater.
Nothing in these Terms limits or excludes liability for intent or gross negligence, or any liability that cannot be limited or excluded under mandatory law.
12. Disclaimers
The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that:
- The Service will be uninterrupted, error-free, or available at all times
- AI-generated itineraries will be accurate, complete, or suitable for your specific needs
- Transport estimates will reflect actual journey times
- Third-party booking links will be available or prices correct at time of visit
13. Termination
We reserve the right to suspend or terminate your account if you violate these Terms, engage in fraudulent activity, or misuse the Service. You may delete your account at any time from your account settings or by emailing us.
Upon termination, your access to paid features will end and your data may be deleted in accordance with our Privacy Policy.
14. Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes by email or in-app notice at least 14 days before they take effect. Continued use of the Service after that date constitutes acceptance of the updated Terms.
15. Governing Law
These Terms are governed by Dutch law. If you are a consumer living in another country, you keep the protection of the mandatory consumer law of that country.
Contact us first if you have a complaint; most issues are resolved quickly that way. Any dispute that cannot be resolved will be submitted to the competent court in Maastricht, the Netherlands. If you are a consumer, you may also bring proceedings in the courts of the place where you live.
